Very thought provoking article. Also, really appreciate the NDA govt atleast attempting a review during its' tenure. I remember the vociferous opposition by the Kkkangress and the Communists who constantly harped on communalism and "toxification". There was no feedback on the efforts and their conclusions. |
Dr Gopal Singh, this article did not outline the manner in which our Constitution might be changed in its working. For that a more holistic view is required as was attempted in my note to the Constitution Review Commission set up by the NDA government, which unfortunately failed to deliver any results. Interesting and incisive! Three questions for you to reflect deeper along these lines of thought: 1. Right now, the legislative, executive (ruling party) and the judicial parts of our government have created internal regulations to prevent CBI from investigating their members/officers without approval from their seniors. Could such a system wipe out this farce arrangement by our government to shield itself from its corrupt practices? 2. Along with the CBI being converted into a constitutional body reporting directly to the President, should there also be a seperate special court also reporting to the President for the explicit purpose of speedy trial for the accused within the three branches of the government? If so, do we need to amend the constitution for that? If not, can the Supreme Court do this job effectively on top of its existing responsibilities? 3. What about the state governments? Can they be held accountable under this proposed scenario? We can't lose site of how rotten they are and how directly they impact the lives of the un-empowered. I realize these require major changes in our existing setup and prhaps our constitution, but a well thought out view with inputs from other readers will refine your suggested approach with a broader appeal for every one. Please give some thought and offer your views. |
