A Point to Ponder

A news item published in Amar Ujala dated 31st May, 2014 is very disturbing.  Its shortened version is,

“The Central government has submitted before the Hon’ble Supreme Court  that it is not authorized to take any action (including removal from the post of NGT chairman), against Justice (Retd.)  Swatantra Kumar because the allegations of sexual  harassment made by an internee against him are of the period when he was Justice of the Supreme Court. The Center has asserted that it is so because the point was thus settled in case of NHRC chairman Justice (Retd.) Balakrishnan (against whom serious allegation of corrupt practices were reported)”.

I remember that some months back it was reported  in the papers that the Hon’ble Supreme Court had decided not to entertain the complaint of the internee because Justice Kumar had already retired.

Will some authority of this country clarify whom this internee should approach for justice. It also raises some more serious questions and doubts about reappointment of and procedure for action against such judges.
